The Telangana High Court directed a private medical college to refund the entire tuition fee of ₹3.32 lakh paid by a student, D. Shabari Priya, who was initially allotted admission into the BHMS course, but the same was cancelled on account of her NEET score. 

The cancellation of admission, irrespective of any justification, cannot result in unjust enrichment of the institution by retaining the amount paid towards the tuition fee for a seat which the student was not permitted to continue, said Justice Juvvadi Sridevi. The student was allotted a seat in the BHMS course in Guru Nanak Homoeopathic Medical College and Hospital at Ibrahimpatnam in 2025 in the management quota following an allotment letter by Kaloji Narayana Rao University of Health Sciences. 

However, the university eventually cancelled the admission on the ground that she got 128 marks in NEET instead of the required 144 marks. The petitioner cannot be made to suffer the financial consequence of a mistake, if any, committed by the university, the judge said.
