'How could a magistrate dare?': CJI fumes over notice to Noida student who joined CJP protest

Chief Justice of India (CJI) Surya Kant on Wednesday slammed a notice issued to a student by the Greater Noida Executive Magistrate and asked how the official could “dare to do” so. The student who received the notice had allegedly attended the Cockroach Janta Party (CJP)-led student protest at Delhi's Jantar Mantar.

“How could a Magistrate dare to issue notice? We made clear no coercive action against any student! No Magistrate could violate that order,” CJI Kant said as a lawyer mentioned the issue before him, reported LiveLaw.

The notice to the Gautam Buddha University (GBU) student had sparked a controversy on Tuesday, but was revoked later.

As stated in an earlier report, the notice was issued based on a police report accusing the student of spreading “anti-government false information” and instigating students to join the CJP protest.

What happened in Supreme Court today?

The matter was brought before CJI Surya Kant on Wednesday as a lawyer cited a September 1 order by the court which had said that mere participation in a protest would not be treated as an offence under penal laws.

“This is an experiment being played with the students of India, and therefore, it would have an all-India implication,” the lawyer said in court.
