The Chief Justice of India quashed FIRs against Samay Raina and others for remarks related to disabilities

On Friday, a Bench of the Chief Justice of India, Justice Surya Kant, along with Justice Joymalya Bagchi and Justice V. Mohana, quashed the FIRs and closed proceedings against Samay Raina and four others – .Balraj Ghai, Sonali Thakker, Nishant Tanwar and Vipul Goyal, for their remarks about people with disabilities on the show, India’s Got Latent.
Lavin Hirani, Managing Partner, Hirani & Associates, who is part of the legal team representing Samay Raina and the others says, “The court did so after taking on record the Respondents’ compliance with its earlier directions among them the Super Heroes Cup 2026, a chess championship for sixteen differently abled players, wider awareness initiatives, and a series of live ticketed shows across Mumbai, Pune and Nagpur. The senior advocate appearing for the petitioner foundation acknowledged before the court that the respondents had made genuine efforts to engage, and the Court recorded that it had no reason to doubt they would continue to work towards celebrating the lives and dignity of persons living with SMA.”

While closing the matter in the capacity of the respondents, the court kept the petition alive on the larger question of framing comprehensive guidelines and safeguards for online content concerning persons with disabilities, and has sought a revised proposal in that regard. “The detailed order is still awaited on record; this account is based on the proceedings in open court,” says Hirani.
