Kalyan-Dombivli Municipal Corporation Ordered by High Court
Dombivli – The Bombay High Court has directed the Kalyan-Dombivli Municipal Corporation (KDMC) to demolish a commercial building named Shubharambh Banquet Hall, located near Dawdi village on Kalyan-Shil Road, within the next four weeks.
Background and Details:
Social worker and Right to Information (RTI) activist Preeti Kuthe brought the illegal and unauthorized construction to the notice of KDMC officials and employees in 2021. Despite KDMC issuing orders to demolish the building, the concerned ward officer, Sanjay Sable, neglected to take action against the unauthorized structure.
The commercial building in question is a ground-plus-three-storey structure. The ground floor houses a new car showroom, the first floor contains a wedding hall, and the second and third floors are occupied by lodging and boarding facilities, along with an office named Gupta Galaxy.
Due to the building’s illegal, unauthorized, and unlawful status, the risk of potential accidents cannot be ruled out. Despite repeated complaints from activist Preeti Kuthe, no action was taken by the municipal administration. Consequently, Kuthe approached the court for justice.
Court Intervention:
Represented by advocate Nikhil Waje, Kuthe sought the intervention of the Bombay High Court. On July 24, 2024, the court ordered the municipal administration to demolish the illegal construction within four weeks.
This ruling by the Bombay High Court emphasizes the importance of upholding the law and taking prompt action against unauthorized constructions to ensure public safety.
