Mira Bhayandar :- The construction of a 500-bed hospital building by the Mira-Bhayander Municipal Corporation has been stalled for the past year due to fraud by the developer. The groundbreaking ceremony for this hospital was conducted by Chief Minister Eknath Shinde. The Assistant Director of Town Planning, Purushottam Shinde, has filed a complaint with the Chief Planning Officer of the Maharashtra Real Estate Regulatory Authority (MahaRERA), accusing the developer of violating municipal conditions and misusing the permissions granted.
Instead of constructing the hospital building first, as per the conditions laid out by the municipality, the developer commenced work on residential buildings within their project and started accepting bookings. The developer allegedly collected crores of rupees from customers under the pretense of flat bookings, thereby violating the municipality’s terms. A request has also been made to the Sub-Registrar’s office to ban the registration of flats or shops in the project.
On October 7, 2022, the Mira-Bhayander Municipal Corporation granted permission to builder Atul Shah for integrated development on approximately 5 acres of land in the Kanakia area, designated for hospital purposes under Reservation No. 302. According to the provisions of the state’s UDCPR, the then-Commissioner approved a plan allowing the construction of a hospital on 40% of the land and residential and commercial buildings on the remaining 60%.
As per the agreement, the developer was to build the 500-bed hospital first and transfer it to the municipality before proceeding with their own construction projects. The groundbreaking ceremony for the proposed hospital was conducted by Chief Minister Eknath Shinde. However, the developer started their own project without completing the hospital, collecting crores from customers.
As a result, on June 21, 2023, the municipality issued a suspension order on the builder’s construction permission. The developer challenged this order in court. Despite the suspension order, the developer, in partnership with Sunteck Company, initiated the Skypark project and aggressively started bookings for flats and shops. MLA Pratap Sarnaik has demanded legal action against developer Atul Shah and Sunteck Company for financial fraud against customers.
Despite the groundbreaking ceremony conducted by the Chief Minister, the hospital’s construction has yet to begin. MLA Sarnaik has accused the developer of deceiving the municipality and suggested that the municipality should take possession of the land by providing TDR (Transferable Development Rights) to the developer. He also demanded the construction of a 500-bed cashless hospital, a 50-bed dialysis center, and a cancer hospital funded by the government on the site.
In a similar case, Ravi Developers have been accused of fraud involving Reservations plots. The developer falsely relocated reservation plots and, as per the conditions mentioned while granting construction permission, was supposed to develop and hand over these reservations to the municipal corporation. It has been more than 14 years, and the conditions remain unfulfilled with no adequate actions taken by the municipal authorities. We will update the details of this fraud in an upcoming edition. This further highlights the ongoing issues of developers not adhering to municipal conditions, leading to significant delays and unfulfilled promises to the community.
